Terms & Conditions

 

These terms and conditions are entered into by and between The Studio @ The Mill (hereinafter: “The Studio”) and You (hereinafter: “the Member”).

​

Services:

​

The membership entitles the usage of The Studio facilities and the equipment & services available therein.

​

Membership:

​

The membership is personal and cannot be shared or transferred.

​

Age Limit:

​

The Member confirms that he/she is 18 years old or older. For persons 16 or 17 years old, exceptions are granted based on a written parental consent. Persons under 16 years of age must be supervised by an adult at all times.

​

Health:

​

The Member confirms that he/she does not suffer from health problems that would hinder exercise or prevent him/her from engaging in exercise, or that would be detrimental or adverse to the Member’s health, safety or physical condition if he/she did exercise. In case of any doubt, the Member shall seek advice by a medical doctor who should confirm the ability to exercise.

​

The Studio shall have no obligation to perform a fitness assessment or similar testing to determine the Member’s physical condition. If an assessment is done at The Studio, it is for the sole purpose of compiling comparative data in order to track the Member’s progress in a programme and not for diagnostic purposes.

​

Liability:

​

Each Member of The Studio shall be liable for any property damage and/or personal injury caused by the Member on the The Studio premises. It shall be the obligation of the Member to pay for any costs involved upon presentation of a statement thereof.

​

Waiver of Liability:

​

Any and all use of the The Studio facilities shall be at Member’s own risk at all times. The Member shall not utilise any equipment unless he/she knows the appropriate usage. The Studio shall not be liable for any injuries, physical impact or damages to the Member, or the property of the Member, or be subject to any claim arising out of the use of the premises and/or of the equipment made available to the users.

Lockers for Personal Belongings:

​

Lockers are available for Members while working out in the facility. Each Member needs to empty the locker when leaving the facility. The Studio reserves the right to open and empty lockers if the Member is not in the facility.

​

Lost Property or Theft:

​

The Studio does not take responsibility for loss or theft of any personal belongings. Any items left on The Studio premises will be kept for a period of two weeks before being disposed of.

​

Code of Conduct:

​

The Member shall respect the behavioural and operating principles of The Studio, as laid out in our code of conduct.

​

Suspension/Termination of Membership:

​

If the Member behaves in a way that breaches the code of conduct membership can be suspended or terminated at management’s sole discretion.

​

Access & Security:

​

The Studio is open Monday to Saturday during the times listed on our timetable, with the exception of bank holidays and exceptional circumstances, when times may vary.  Classes are available according to times stated in the booking system. Classes and instructors are subject to change with no prior notice.

 

In the event access to the facility is restricted or refused for any reason, including but not limited to self-isolation, enforced closure, or local lockdown, all sessions and classes will be transferred online with a revised timetable where required. Memberships will continue as normal and monthly payments will continue to be taken by Harlands.

Sessions:

​

Sessions can be booked up to 30 days in advance, or up to 1 hour before the start time for classes, and 6 hours before the start time for PT sessions and Open Gym. Cut off times are reviewed regularly and are subject to change. Once booked, sessions can be cancelled subject to a 6-hour cancellation policy. All cancellation policies are managed and automated through the booking system.

 

Unmanned Hours:

​

Unmanned hours are provided for our members to access the facility during times we would otherwise be closed. CCTV will be monitored and recorded for public safety. The member accepts their own responsibility and understands there will be no first aider on site during unmanned hours. The member must always carry a mobile phone in case of an emergency and must report any incidents or injuries to The Studio before leaving so this can be logged. The member must not enter The Studio unless they have a pre-booked session. The member must use the key fob provided to gain entrance to The Studio and must not let anyone other than themselves into The Studio.

Payments & Unsucessful Payment Fees:

​

The Member is responsible for the payment of the membership. Direct Debit payments are collected by GoCardless and Stripe and are in accordance with the terms agreed with them upon sign-up, a copy of which can be provided upon request.

​

Monthly Memberships - the first month’s payment or pro-rata amount and any sign-up fee are paid at the point of this agreement. The following monthly payments should be paid on the 1st of each month. The member is responsible for all payments.

​

If a payment is unsuccessful, the member agrees to pay an additional fee to cover the processing fees incurred by The Studio each time the payment is retried. This will be equal to the fees charged by GoCardless or Stripe, plus a reasonable admin fee where appropriate. The Studio reserves the right to transfer the case to a debt collector, which will add additional fees.

The Member has given approval for an automatic debit from his/her account or card and the cancellation must be announced after the initial contract period and a minimum of 30 days before the next debit.

​

Refunds will not be given under any circumstance.

​

Renewal & Cancellation:

​

Annual membership (12 months pre-paid): The contract runs for 12 months, during which time it cannot be cancelled. At the end of the contract period, the membership is automatically renewed unless the Member notifies The Studio at latest 30 days before the end of the contract period. The member must use the booking system to manage the cancellation of their membership.

​

Monthly membership 30 days notice (monthly debit/credit card, or direct debit payment): the membership is on a monthly rolling basis and is renewed automatically on the payment due date each month. The member may cancel their membership at any time at least 30 days prior to their next renewal date. The member must use the booking system to manage the cancellation of their membership.

 

Monthly membership no notice (monthly debit/credit card, or direct debit payment): the membership is on a monthly rolling basis and is renewed automatically on the payment due date each month. The member may cancel their membership at any time with no further payments being due. The member must use the booking system to manage the cancellation of their membership.

 

Refunds for unused memberships will not be given under any circumstance.


Price Changes:

​

All prices are fixed for the duration of a contract. For memberships out of a fixed contract period, and for monthly rolling memberships, an automatic price increase will be implemented on 1st January each year equalling 5% or inflation whichever is the highest. Any additional price changes will be communicated at least 30 days prior to implementation. The member may cancel their membership or change to a different membership subject to the minimum notice period required as outlined above.

​

Photography & Video:

The Studio reserve the right to take photographs and / or videos within The Studio (which may include you) for promotional purposes in print, online and for social media. You agree to photos being taken and used in this way unless you inform us in writing. It is your responsibility to ensure we are informed at the time any photos and videos are taken if you wish to be excluded.

 

CCTV:

CCTV is recorded and monitored within The Studio. Please see our Privacy Policy for details.

Changes to these terms:

​

We will occasionally update our terms and, where appropriate, notify you using any of the contact details we hold for you for this purpose. This may include phone, SMS, e-mail, post, or interactive social media.
